Nitekim Kitab-\u0131 Mukaddes\u2019te Hz. \u0130brahim, Hz. Yakub, Hz. D\u00e2vud, Hz. S\u00fcleyman ve di\u011fer pek \u00e7ok peygamberin birden fazla evli oldu\u011fu bildirilmektedir. Di\u011fer k\u00fclt\u00fcr ve milletlerde de \u00e7ok evlili\u011fe izin verilmi\u015f veya te\u015fvik edilmi\u015f olup buna bir s\u0131n\u0131r da getirilmemi\u015ftir. <b>Prof. Dr. M. Hamidullah<\/b>\u2019\u0131n ifadesiyle, \u0130sl\u00e2m dini \u00e7ok evlili\u011fi (poligami) s\u0131n\u0131rland\u0131ran ilk ve yag\u00e2ne dindir. Ne Hz. Musa ne de Hz. \u0130sa, zevcelerin say\u0131s\u0131n\u0131 s\u0131n\u0131rland\u0131rmam\u0131\u015ft\u0131r. (<i>Kur\u2019\u00e2n-\u0131 Ker\u00eem Tarihi,<\/i> s. 32)<\/p>\n<p>\u0130sl\u00e2m, esas itibariyle tek evlili\u011fi \u0131srarla tavsiye etmi\u015f, ad\u00e2letten ayr\u0131lmamak ve \u00e2ilenin ge\u00e7imini rahat\u00e7a sa\u011flayabilmek i\u00e7in en uygun tercihin tek evlilik oldu\u011funu bildirmi\u015f, ancak zar\u00fbret hallerinde belli \u015fartlar d\u00e2hilinde birden fazla evlili\u011fe de m\u00fcsaade etmi\u015ftir. Bunun da \u00fcst s\u0131n\u0131r\u0131 d\u00f6rt\u2019t\u00fcr.<a title=\"\" href=\"file:\/\/\/E:\/Vesaik\/Kitap_Calismalari\/Ebedi_Yol_Haritasi_islam\/Ebedi_Yol_Haritasi_islam_Gozden_Gecirilmis_Yeni_Baski.doc#_ftn1\">[1]<\/a> Sava\u015f, hastal\u0131k, sakatl\u0131k, uzun ayr\u0131l\u0131klar gibi sebeplerle \u00e2ilelerin par\u00e7alanmamas\u0131, kad\u0131nlar\u0131n sahipsiz ve him\u00e2yesiz kalmamas\u0131 i\u00e7in gerekti\u011finde buna m\u00fcsaade edilebilir. Mesel\u00e2 \u00e7ocuk do\u011furmayan veya fizik\u00ee-biyolojik durumu m\u00fcsait olmayan bir kad\u0131nla evlenmi\u015f olan bir ki\u015fi, o kad\u0131n\u0131 bo\u015famaks\u0131z\u0131n ikinci bir kad\u0131n daha alabilir. B\u00f6ylece bir \u00e2ilenin y\u0131k\u0131lmas\u0131ndan do\u011facak madd\u00ee-m\u00e2nev\u00ee zararlar asgar\u00eeye indirilmi\u015f olur.<\/p>\n<p>Harp g\u00f6rm\u00fc\u015f bir memlekette birden fazla evlili\u011fe izin vermek, azalan n\u00fcf\u00fbsun tel\u00e2f\u00eesi ve fuh\u015fun \u00f6nlenmesi i\u00e7in bir zar\u00fbret h\u00e2line gelebilir. Bunun mis\u00e2lleri ge\u00e7mi\u015fte Almanya ve benzeri memleketlerde g\u00f6r\u00fcld\u00fc\u011f\u00fc gibi gelecekte de ortaya \u00e7\u0131kabilir. Bu t\u00fcr ruhs\u00e2t ve izinler, hayat\u0131 rahatlat\u0131r ve tabi\u00ee seyrinde devam\u0131n\u0131 sa\u011flar. \u0130\u015fte bu keyfiyet, \u0130sl\u00e2m\u2019\u0131n her zaman ve mek\u00e2n i\u00e7in hayat\u00ee zar\u00fbretleri kar\u015f\u0131layabilecek bir vas\u0131fta oldu\u011funu g\u00f6stermektedir.<\/p>\n<p>Bu \u015fekilde ferd\u00ee, \u00e2ilev\u00ee ve i\u00e7tim\u00e2\u00ee sebeplerle birden fazla kad\u0131nla evlenmek zorunda kalan ki\u015filerin, han\u0131mlar aras\u0131nda ad\u00e2leti sa\u011flamas\u0131 ve hepsinin madd\u00ee m\u00e2nev\u00ee ihtiya\u00e7lar\u0131n\u0131 kar\u015f\u0131lamas\u0131 gerekmektedir. Ras\u00fblullah r \u015f\u00f6yle buyurur:<\/p>\n<p><i>\u201cBir erke\u011fin nik\u00e2h\u0131nda iki kad\u0131n bulunur da, aralar\u0131nda ad\u00e2let g\u00f6zetmezse, k\u0131y\u00e2met g\u00fcn\u00fcnde bir taraf\u0131 fel\u00e7li olarak diriltilir.\u201d<\/i> (\u0130bn-i M\u00e2ce, Nik\u00e2h, 47)<\/p>\n<p><b><i>Bu teorik imk\u00e2na ra\u011fmen \u0130sl\u00e2m toplumunda birden fazla evlilik yayg\u0131nla\u015fmam\u0131\u015ft\u0131r.<\/i><\/b> Zira bu hususta getirilen \u015fartlar \u00e2det\u00e2 m\u00fcsl\u00fcmanlara; \u201cBirden fazla evlenmeyiniz!\u201d demektedir.<a title=\"\" href=\"file:\/\/\/E:\/Vesaik\/Kitap_Calismalari\/Ebedi_Yol_Haritasi_islam\/Ebedi_Yol_Haritasi_islam_Gozden_Gecirilmis_Yeni_Baski.doc#_ftn2\">[2]<\/a> B\u00fcy\u00fck \u0130sl\u00e2m \u00e2limlerinden Zemah\u015fer\u00ee, <i>Nev\u00e2bi\u011fu\u2019l-kelim<\/i> isimli eserinde:<\/p>\n<p><b><i>\u201cDenizde dalgalarla bo\u011fu\u015fanlar m\u0131, yoksa birden \u00e7ok kad\u0131na koca olanlar m\u0131 daha t\u00e2lihsizdir, bilemem!\u201d<\/i><\/b> demi\u015ftir.<\/p>\n<p>Osmanl\u0131 tereke defterleri \u00fczerinde yap\u0131lan ara\u015ft\u0131rmalar, \u015fehir veya k\u0131rsal kesimde ya\u015fama duru\u00admuna ba\u011fl\u0131 olarak birden fazla evlilik oran\u0131n\u0131n % 5-9 civar\u0131nda oldu\u011funu ortaya koymakta\u00add\u0131r. Bunlar da <b>um\u00fbmiyetle ikinci evlilikle iktif\u00e2 etmi\u015ftir.<\/b> Birden fazla evlilik oran\u0131 son d\u00f6neme ait n\u00fcfus kay\u0131t\u00adlar\u0131ndan daha a\u00e7\u0131k bir \u015fekilde tesbit edilebilmektedir. \u0130stanbul\u2019da 1885 y\u0131l\u0131nda birden fazla evlilik oran\u0131 % 2,52, 1907\u2019de % 2,16\u2019d\u0131r.<a title=\"\" href=\"file:\/\/\/E:\/Vesaik\/Kitap_Calismalari\/Ebedi_Yol_Haritasi_islam\/Ebedi_Yol_Haritasi_islam_Gozden_Gecirilmis_Yeni_Baski.doc#_ftn3\">[3]<\/a><\/p>\n<p>Osmanl\u0131 Devleti\u2019ne gelen seyyahlar, eserlerinde, birden fazla evlili\u011fin halk aras\u0131nda yayg\u0131n olmad\u0131\u011f\u0131n\u0131, fakirlerde ise hi\u00e7 rastlanmad\u0131\u011f\u0131n\u0131 ifade ederler. O h\u00e2lde bu mevz\u00fbun bug\u00fcne kadar abart\u0131ld\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r.<a title=\"\" href=\"file:\/\/\/E:\/Vesaik\/Kitap_Calismalari\/Ebedi_Yol_Haritasi_islam\/Ebedi_Yol_Haritasi_islam_Gozden_Gecirilmis_Yeni_Baski.doc#_ftn4\">[4]<\/a><\/p>\n<p><b>Cat Stevens,<\/b> bu hususta \u015f\u00f6yle der:<\/p>\n<p>\u201c\u0130sl\u00e2m, kad\u0131na, bug\u00fcn bir\u00e7ok ki\u015finin r\u00fcy\u00e2s\u0131nda bile g\u00f6remedi\u011fi haklar\u0131 1400 sene evvel hediye etmi\u015ftir. Bug\u00fcn d\u00fcnyada m\u00fcsl\u00fcman erkeklerin % 99\u2019u tek evlidir. Bat\u0131l\u0131 erke\u011fin bir tek kar\u0131s\u0131 vard\u0131r, ancak metreslerinin say\u0131s\u0131 belli de\u011fildir\u2026\u201d (<i>\u0130sl\u00e2m \u00dczerine Konu\u015fmalar,<\/i> s. 6)<\/p>\n<p>Birden fazla kad\u0131nla m\u00fcnasebette bulunmak, toplumlarda zanne\u00addildi\u011finden \u00e7ok daha yayg\u0131n g\u00f6r\u00fcnmektedir. Bu mesele huk\u00fbk\u00ee bir zemine oturtulmazsa, ikinci kad\u0131n \u00e7e\u015fitli haklar, sosyal bask\u0131 ve benzeri y\u00f6nlerden zarar g\u00f6rd\u00fc\u011f\u00fc gibi ilk han\u0131m da gayr-i me\u015fr\u00fb yollara ba\u015fvuran bir erkekle evli olma\u00adn\u0131n \u00e7e\u015fitli s\u0131k\u0131nt\u0131lar\u0131n\u0131 \u00e7eker. Ayr\u0131ca do\u011facak \u00e7ocuklar, \u00e2ile m\u00fcessesesi ve toplum da muhtelif problemlerle kar\u015f\u0131la\u015f\u0131r. \u0130sl\u00e2m bu zararlar\u0131 \u00f6nlemek i\u00e7in birden fazla evlili\u011fi huk\u00fbk\u00ee bir zemine oturtmu\u015ftur. Dolay\u0131s\u0131yla <b><i>birden fazla evlilik \u0130sl\u00e2m\u2019\u0131n ihtiya\u00e7 h\u00e2linde, belli kay\u0131t ve \u015fartlarda kullan\u0131\u00adlabilen bir m\u00fcs\u00e2adesi, toplumda denge\u00adyi sa\u011flayan ve baz\u0131 problemleri \u00e7\u00f6zen bir \u00e7\u00f6z\u00fcm \u015fekli ve bir t\u00fcr \u201csosyal sigor\u00adta\u201d olarak kabul edilmelidir.<\/i><\/b><a title=\"\" href=\"file:\/\/\/E:\/Vesaik\/Kitap_Calismalari\/Ebedi_Yol_Haritasi_islam\/Ebedi_Yol_Haritasi_islam_Gozden_Gecirilmis_Yeni_Baski.doc#_ftn5\">[5]<\/a><\/p>\n<p>Di\u011fer bir husus da, e\u015flerinin ikinci evlili\u011fini istemeyen ka\u00add\u0131nlar, Hanbel\u00ee mezhebine g\u00f6re bunu ni\u00adk\u00e2h esnas\u0131nda \u015fart olarak ileri s\u00fcrebilir ve bu \u015fart ba\u011flay\u0131c\u0131 olur. Uygulamada bunun pek\u00e7ok \u00f6r\u00adne\u011fine rastlamak m\u00fcmk\u00fcnd\u00fcr. <b>Huk\u00fbk-\u0131 \u00c2ile Kararna\u00admesi<\/b> de 38. maddesinde bu \u015fart\u0131n ge\u00e7erli ve ba\u011flay\u0131c\u0131 ol\u00addu\u011funu kabul etmi\u015ftir.<a title=\"\" href=\"file:\/\/\/E:\/Vesaik\/Kitap_Calismalari\/Ebedi_Yol_Haritasi_islam\/Ebedi_Yol_Haritasi_islam_Gozden_Gecirilmis_Yeni_Baski.doc#_ftn6\">[6]<\/a><\/p>\n<p>Herhangi bir zorlay\u0131c\u0131 sebep olmadan birden fazla han\u0131mla evlenmek \u00e7e\u015fitli mahzurlar\u0131 g\u00f6z \u00f6n\u00fcnde bulundurularak ho\u015f kar\u015f\u0131lanmam\u0131\u015ft\u0131r. Erke\u011fin han\u0131mlar\u0131 aras\u0131ndaki ad\u00e2leti sa\u011flamas\u0131n\u0131n \u00e7ok zor olmas\u0131, kad\u0131nlar\u0131n k\u0131skan\u00e7l\u0131k duygular\u0131 ve neticede \u00e2ile i\u00e7inde muhtelif problemlerin zuhur etmesi, tek evlili\u011fin daha s\u0131hhatli oldu\u011funu g\u00f6stermektedir. Kur\u2019\u00e2n, birden fazla evlilik meselesini, i\u00e7tim\u00e2\u00ee bir yaran\u0131n sar\u0131lmas\u0131 ve ihtiya\u00e7 \u00e2n\u0131nda m\u00fc\u2019minler toplulu\u011funun bir fedak\u00e2rl\u0131\u011fa d\u00e2vet edilmesi sebebiyle s\u00f6zkonusu etmi\u015ftir.<\/p>\n<p>Yarat\u0131l\u0131\u015ftaki il\u00e2h\u00ee g\u00e2yeyi dikkate almadan s\u0131rf d\u00fcz bir mant\u0131k ile bak\u0131ld\u0131\u011f\u0131nda, kad\u0131n\u0131n da birden fazla kocas\u0131n\u0131n olmas\u0131 m\u00e2kul gibi g\u00f6r\u00fclse de bu asl\u00e2 do\u011fru de\u011fildir. \u00c7\u00fcnk\u00fc bu takdirde do\u011facak \u00e7ocu\u011fun nesebi ihtil\u00e2fl\u0131 olur. Kime nisbet edilmesi l\u00e2z\u0131m geldi\u011fi bilinemez.
